Terms of Service

These Terms of Service apply to the use of the Mulcheva website, requests for quotations, orders, project agreements, invoices, deliveries and all products and services supplied by Mulcheva.

By using our website, requesting a quotation, placing an order, approving a project, accepting an invoice or purchasing from Mulcheva, you agree to these Terms of Service.

1. Company and business focus

Mulcheva supplies exclusive glass products and custom glass solutions for professional clients, B2B buyers, resellers, contractors, architects, interior designers, project developers, hospitality clients and project-based customers.

Our products may include, but are not limited to:

  • Glassboards and glass whiteboards

  • Printed glass boards

  • Coloured, round, organic and mobile glassboards

  • Laminated glass

  • Glass tabletops

  • Mirrors and LED mirrors

  • Glass doors

  • Kitchen backsplashes

  • Glass wall panels

  • Glass office and partition walls

  • Balcony glazing

  • Custom glass solutions

  • Project-specific glass products

Mulcheva mainly operates as a B2B and project-based supplier. Products may be standard, custom-made, made to order, specially sourced or produced according to customer specifications.

2. B2B transactions

Orders placed by businesses, professional buyers, resellers, contractors, architects, interior designers, project developers or other commercial customers are considered B2B transactions.

For B2B transactions, the customer confirms that they are purchasing for business or professional purposes. Consumer protection rules, including consumer withdrawal rights, may not apply to B2B purchases.

3. Quotations and offers

All quotations, offers, price indications and proposals from Mulcheva are non-binding unless explicitly stated otherwise in writing.

A quotation may be based on the information supplied by the customer, including measurements, drawings, specifications, quantities, delivery location, project requirements and selected product options.

Mulcheva may correct obvious errors, typing mistakes, pricing mistakes or calculation errors at any time.

A quotation is valid only for the period stated in the quotation. If no validity period is stated, Mulcheva may withdraw or change the quotation at any time before written acceptance.

4. Orders and order confirmation

An order is only confirmed once Mulcheva has accepted the order in writing, issued an invoice, received payment where required, or confirmed the start of sourcing, planning or production.

The customer is responsible for checking all order details before approval, including:

  • Product type

  • Measurements

  • Quantities

  • Colours

  • Finishes

  • Printing files

  • Drawings

  • Delivery address

  • Installation or project details

  • Any technical specifications

Once an order is confirmed, changes may not always be possible. If changes are requested after confirmation, additional costs and delays may apply.

5. Custom-made and made-to-order products

Many Mulcheva products are custom-made, made to order, specially sourced or produced for a specific project.

Custom-made, made-to-order, specially sourced and project-specific products cannot be cancelled, returned, exchanged or refunded after confirmation, unless the product is defective, damaged upon delivery, or does not match the confirmed order specifications.

If production, customization, sourcing or project preparation has started, cancellation may no longer be possible.

6. Customer information, measurements and specifications

The customer is responsible for providing correct and complete information, including measurements, drawings, artwork, files, site conditions, installation details and project requirements.

Mulcheva is not responsible for errors, delays, extra costs or unsuitable products caused by incorrect, incomplete or unclear information supplied by the customer.

If a product is produced according to incorrect measurements, drawings, artwork or specifications supplied by the customer, the product cannot be returned or refunded.

7. Prices and VAT

Prices may be shown excluding or including VAT depending on the type of customer, market, platform or quotation.

For B2B customers, prices may be shown excluding VAT where legally permitted.

Shipping, transport, packaging, installation, import duties, taxes, customs costs and additional project costs may be charged separately unless explicitly included in writing.

Mulcheva reserves the right to change prices before an order is confirmed.

8. Payment

Payment terms are stated on the quotation, invoice or order confirmation.

Mulcheva may require full payment, partial payment, a deposit or payment before production, shipment or delivery.

If payment is late, Mulcheva may pause production, delay delivery, suspend services, charge statutory interest, charge collection costs or cancel the order, without prejudice to any other rights.

Ownership of products remains with Mulcheva until full payment has been received, unless otherwise agreed in writing.

9. Production times and delivery times

Production times, delivery times and project timelines are estimates unless explicitly guaranteed in writing.

Delays may occur due to production, supplier availability, transport, customs, technical issues, payment delays, customer changes, incomplete information or force majeure.

Mulcheva is not liable for indirect damage, lost profits, project delays, missed deadlines or other losses caused by delayed delivery, unless required by mandatory law.

10. Delivery and risk

Delivery takes place at the agreed delivery address or collection point.

Risk of loss or damage may pass to the customer upon delivery, collection, handover to the carrier or another agreed delivery moment.

The customer must ensure that the delivery location is accessible, safe and suitable for delivery of glass products.

If delivery cannot take place due to incorrect information, absence, lack of access or unsafe conditions, additional transport, storage or handling costs may be charged.

11. Inspection upon delivery

The customer must inspect all products immediately upon delivery or collection.

Visible damage, transport damage, missing items or defects must be reported to Mulcheva in writing within 48 hours after delivery.

The report must include:

  • Order number or invoice number

  • Clear photos of the product

  • Photos of the packaging

  • Description of the issue

  • Delivery date

  • Any transport damage notes

Products must not be installed, used, modified or disposed of before Mulcheva has reviewed the issue.

12. Installation

Unless explicitly agreed in writing, installation is not included.

If installation is arranged by the customer or a third party, Mulcheva is not responsible for installation errors, incorrect handling, damage during installation or unsuitable site conditions.

The customer is responsible for ensuring that walls, structures, surfaces, measurements and installation conditions are suitable for the product.

13. Product images, colours and tolerances

Images, renders, samples and website photos are for illustration purposes only.

Minor differences in colour, finish, reflection, transparency, print result, dimensions, material appearance or production tolerances may occur and are not considered defects unless explicitly agreed otherwise in writing.

Glass is a technical and visual material, and variations may occur due to lighting, screen settings, production processes and material characteristics.

14. Intellectual property and customer files

All content on the Mulcheva website, including text, images, designs, branding, product presentations and layouts, belongs to Mulcheva or its licensors and may not be copied, reproduced or used without written permission.

If the customer supplies artwork, logos, images, files or designs, the customer confirms that they have the necessary rights to use those materials.

The customer indemnifies Mulcheva against claims related to copyright, trademark, design rights or other intellectual property rights arising from customer-supplied materials.

15. Returns and refunds

Returns, refunds and cancellations are governed by our Return and Refund Policy.

Custom-made, made-to-order, specially sourced and project-specific products are generally non-returnable and non-refundable unless defective, damaged upon delivery, or not in accordance with the confirmed order specifications.

16. Warranty and defects

Mulcheva will review warranty or defect claims on a case-by-case basis.

A warranty does not apply to damage caused by:

  • Incorrect installation

  • Incorrect use

  • Normal wear and tear

  • Improper cleaning

  • Impact, scratches or breakage after delivery

  • Customer modifications

  • Unsuitable site conditions

  • Incorrect measurements or specifications supplied by the customer

  • Handling by third parties

  • Use outside the intended purpose

If a valid defect is confirmed, Mulcheva may choose to repair, replace, partially refund or offer another reasonable solution.

17. Limitation of liability

To the maximum extent permitted by law, Mulcheva is not liable for indirect damages, consequential damages, loss of profit, loss of revenue, loss of business, project delays, installation costs, removal costs, replacement costs by third parties or reputational damage.

Mulcheva’s total liability is limited to the amount paid by the customer for the specific product or order giving rise to the claim, unless mandatory law requires otherwise.

18. Force majeure

Mulcheva is not liable for failure or delay caused by circumstances beyond its reasonable control.

This may include, but is not limited to, supplier delays, transport issues, customs delays, production problems, strikes, material shortages, energy disruptions, illness, accidents, extreme weather, war, government measures, technical failures or other force majeure events.

19. Website use

The customer may not misuse the Mulcheva website, attempt to disrupt the website, copy content, use the website for unlawful purposes or submit false, misleading or harmful information.

Mulcheva may update, change or remove website content, product information, prices or availability at any time.

20. Privacy

Personal data is processed according to our Privacy Policy.

By using the website or placing an order, the customer acknowledges that Mulcheva may process information necessary for quotations, orders, payments, delivery, customer service, marketing, analytics and legal compliance.

21. Changes to these Terms

Mulcheva may update these Terms of Service from time to time.

The version published on the website at the time of quotation, order confirmation or purchase applies, unless otherwise agreed in writing.

22. Governing law and disputes

Unless otherwise required by mandatory law or agreed in writing, these Terms of Service and all agreements with Mulcheva are governed by the laws applicable to the registered business location of Mulcheva.

Any dispute will first be discussed in good faith between the parties. If no solution is reached, disputes may be submitted to the competent court or authority according to applicable law.
